Terms of Service for Tons of XP

1. Introduction & Acceptance
Welcome to Tons of XP ("we," "us," "our"). We provide various services related to the online game Old School RuneScape (OSRS). By accessing our website (https://tonsofxp.com) or using any of our services (obtained via Live Chat, Discord, or other official communication channels), you ("you," "user," "customer") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our website or services.
2. Description of Services
We offer a range of services within Old School RuneScape, potentially including but not limited to skilling, questing, minigames, item farming, and other account-related tasks ("Services").
- Specific Service Details: The exact scope, requirements, estimated timeframes, and pricing for any specific Service will be discussed and agreed upon via our official communication channels (primarily Website Live Chat or Discord) before the Service commences.
- Pricing: Prices are fixed once agreed upon during our discussion. Any potential extra costs (e.g., for specific supplies not covered by the base price) will also be discussed and agreed upon beforehand.
- Non-Affiliation: We are not affiliated with, endorsed by, or connected in any way to Jagex Ltd., the creators and operators of Old School RuneScape.
3. User Responsibilities & Account Security
- Accurate Information: You must provide accurate and complete information necessary for the Service.
- For account-related services, this includes your OSRS username and password, and potentially authentication codes (see below).
- For gold delivery services, specific information requirements will be communicated during the order process.
- Pre-Service Preparation (Account Services): Before we begin an account-related Service, you must:
- Change your OSRS account password to a unique, temporary password specifically for the duration of the Service.
- Remove any significant wealth or valuable items from the account that are not strictly required for the Service. We are not liable for items/wealth left on the account beyond what is necessary for the agreed-upon Service (See Section 8).
- Ensure any prerequisite requirements (stats, items, quests) discussed and agreed upon via chat/Discord are met.
- During Service: You agree not to log into the OSRS account while the Service is actively being performed, unless specifically agreed upon with us beforehand. Doing so may disrupt the service and void any time guarantees or potentially affect completion.
- Post-Service Action: Immediately after we notify you that the Service is complete, you must change your OSRS account password again to a new, secure password.
- Account Security & Authentication:
- We strongly recommend keeping the RuneScape Authenticator (2FA) active on your account.
- We discourage disabling the Authenticator. The preferred method for access, if required, is for you to provide temporary Jagex backup codes as needed. You understand the security implications of sharing any access codes.
- Access to your account details will be limited strictly to the worker assigned to perform your Service.
- Risk Acknowledgment: You explicitly understand and acknowledge that using third-party services like ours violates Jagex Ltd.'s Terms of Service and Rules of RuneScape. This carries an inherent risk of actions being taken against your OSRS account by Jagex, including temporary or permanent bans. You assume full and sole responsibility for this risk.
4. Ordering and Payment
- Ordering: Services must be ordered and agreed upon via our official Website Live Chat or Discord server.
- Payment Methods: We currently accept payment via specified Cryptocurrencies and OSRS Gold (RSGP). Accepted types will be confirmed during the order discussion.
- Payment Timing: Payment is required in full upfront before the Service begins, unless explicitly agreed otherwise in writing during the order discussion.
- Finality: All payments are final, except as outlined in our Refund Policy (Section 6).
5. Service Delivery & Completion
- Estimated Timeframes (ETAs): We may provide an estimated timeframe for completion before the service begins. These are good-faith estimates and delays can occur due to game updates, server issues, or unforeseen complexities. We will strive to notify you of significant delays via the communication channel used for the order (primarily Discord).
- Communication: We will primarily use Discord for progress updates if requested or necessary. You may also inquire about progress via Website Live Chat.
- Completion: A Service is considered complete when the agreed-upon objective has been met. We will notify you upon completion, typically via Discord or Live Chat, and can provide screenshot evidence upon request.
6. Refund & Cancellation Policy
- General Policy: Due to the nature of the services and the upfront commitment of resources, all payments are final and non-refundable once a Service has commenced.
- Strict Refund Exception: A partial refund may be issued only in the specific circumstance where we are demonstrably unable to continue or complete the agreed-upon Service due to reasons solely within our control (excluding game updates, server issues, or actions by Jagex). In such rare cases, any refund will be prorated based only on the portion of the work not completed.
- No Refunds For: Refunds will not be issued under any circumstances for:
- Account warnings, suspensions, or bans issued by Jagex at any time (before, during, or after the Service), as this risk is fully assumed by you.
- If you change your mind after the Service has started.
- Delays outside of our direct control.
- If you interfere with the Service (e.g., logging in without permission).
- If prerequisites were not met as agreed.
- Cancellation: Orders cannot be cancelled by the user once the Service has commenced.
7. Chargebacks & Disputes
- Dispute Resolution: If you have any issue or concern with a Service, you agree to contact us directly first via Website Live Chat or Discord to seek a resolution.
- Chargebacks: Initiating a payment chargeback without first contacting us and allowing a reasonable time for resolution will be considered a violation of these Terms. We reserve the right to dispute any chargebacks and may blacklist users who initiate unwarranted chargebacks from future services.
8. Disclaimers & Limitation of Liability
- Jagex ToS Violation Risk: You explicitly acknowledge and agree that using our services is against Jagex Ltd.'s rules and carries the risk of account suspension or termination. Tons of XP takes precautions to minimize detection risks, but we offer no guarantee against actions taken by Jagex. You assume 100% of the risk.
- "As Is" Service: Services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
- Limitation of Liability: To the maximum extent permitted by law, Tons of XP shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the service; (ii) any action taken by Jagex Ltd. against your OSRS account; (iii) any unauthorized access, use or alteration of your transmissions or content.
- Liability Cap: In no event shall Tons of XP's aggregate liability for all claims relating to the services exceed the total amount paid by you to us for the specific service giving rise to the claim. We are explicitly not liable for the value of items or wealth left on an account if you did not clear it as required in Section 3.
9. Prohibited Conduct
You agree not to:
- Provide false, inaccurate, or misleading information.
- Engage in fraudulent activities, including using stolen payment methods.
- Harass our staff or other users.
- Initiate chargebacks without attempting good-faith resolution with us first (as per Section 7).
- Use our services for any illegal or illicit purpose.
10. Termination
- We reserve the right to refuse or terminate service to anyone at any time, without notice or liability, for any reason, including but not limited to, a breach of these Terms or suspicion of fraudulent activity.
- You may stop using our services at any time, subject to the Refund and Cancellation Policy (Section 6).
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Belgium, without regard to its conflict of law provisions.
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will indicate changes by updating the "Effective Date" at the top of this page. Your continued use of the website or services after any such changes constitutes your acceptance of the new Terms. We encourage you to review these Terms periodically.
